Terms of Service
These Terms of Service (“Terms”) govern your access to and use of Catchara’s website and AI phone receptionist services (the “Services”). By creating an account, starting a trial, or using the Services, you agree to these Terms.
1. The Services
Catchara provides a self-serve AI phone receptionist that can answer calls, qualify leads, book appointments, send SMS confirmations, and transfer calls according to your configuration. Features may evolve; we may modify or discontinue functionality with reasonable notice when practical.
2. Eligibility & accounts
You must be at least 18 and able to form a binding contract. You are responsible for account credentials and for activity under your account. Provide accurate business and contact information.
3. Plans, trials & billing
- Standard plan is offered at $549 per month unless otherwise stated at checkout.
- Trials, if offered, may require a payment method and convert to paid unless canceled before the trial ends.
- Fees are billed in advance in USD. Taxes may apply.
- You may cancel anytime; cancellation stops future renewals. Fees already charged are generally non-refundable except where required by law or expressly stated.
- The Standard plan is a flat monthly fee for normal single-location business use. Catchara may apply fair-use limits, require an upgrade to a custom plan, or suspend abusive usage (including call-center scale volume, unlawful robocalling, or traffic that materially exceeds normal SMB patterns). We do not bill retail customers a public per-minute rate for the Standard plan.
4. Acceptable use
You agree not to use the Services to:
- Violate law (including TCPA, telemarketing, privacy, or recording-consent laws)
- Send spam, phishing, or deceptive communications
- Impersonate others unlawfully or infringe IP rights
- Probe, abuse, or disrupt telephony or AI infrastructure
- Process content you are not authorized to handle
You must configure call recording/AI disclosures as required in your jurisdiction and industry.
5. Your content & callers
You retain ownership of your business content and caller data you provide. You grant Catchara a license to process that data solely to provide and improve the Services. You are responsible for lawful collection and notice to callers who interact with your Catchara line.
6. Third-party services
Integrations (calendars, CRMs, Stripe, carriers, analytics) are subject to their own terms. We are not responsible for third-party outages or policies.
7. Intellectual property
Catchara, our logos, and product software are our property. You may not copy, reverse engineer, or resell the Services except as expressly allowed in writing.
8. Disclaimer of warranties
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. AI OUTPUTS MAY BE INACCURATE; YOU MUST SUPERVISE CRITICAL WORKFLOWS.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CATCHARA WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR LOST-PROFITS DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE THREE (3) MONTHS BEFORE THE CLAIM.
10. Indemnity
You will indemnify and hold Catchara harmless from claims arising from your use of the Services, your call content, your failure to obtain required consents, or your violation of these Terms.
11. Suspension & termination
We may suspend or terminate access for non-payment, abuse, legal risk, or material breach. You may stop using the Services and cancel your account at any time.
12. Governing law
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules, unless a mandatory local law applies to you as a consumer.
13. Changes
We may update these Terms by posting a revised version. Continued use after the effective date constitutes acceptance.
